Section 41
Compensation to be given
: (1) If as a result of any crime, there is any damage to the victim's life, life, property or honor, the court shall pay reasonable compensation to the victim for such damage. But if there is provision for separate compensation in the law for any fault, it will be according to the same.
(2) While determining the compensation as per sub-section (1), the following points shall be considered:-
(a) Physical, physical, mental and emotional harm to the victim,
(b) If the victim has died, the loss suffered by his heirs,
(c) the financial resources and condition of the offender,
(d) The condition of the victim and his dependents,
(e) Other matters deemed appropriate by the court.
(3) When paying the compensation according to sub-section (1), if the victim is injured or disabled as a result of the crime, the medical expenses and in the case of the death of the victim, the appropriate expenses and operational expenses must also be paid.
(4) When the offender damages the property of the victim and pays compensation for the same, such item shall be returned in its original condition.
(5) According to sub-section (4), if it is not possible to return the item as it is, if the value of such item is disclosed, such price, if the price is not disclosed, compensation shall be paid on the basis of the value of such item that can be maintained at the time of damage or punishment.
(6) Compensation can be paid in cash or in kind or both.
(7) If the person suffering from the crime has died before the compensation is paid as per sub-section (1), then the compensation as per sub-section (1) shall be paid to his next of kin.
(2) While determining the compensation as per sub-section (1), the following points shall be considered:-
(a) Physical, physical, mental and emotional harm to the victim,
(b) If the victim has died, the loss suffered by his heirs,
(c) the financial resources and condition of the offender,
(d) The condition of the victim and his dependents,
(e) Other matters deemed appropriate by the court.

(4) When the offender damages the property of the victim and pays compensation for the same, such item shall be returned in its original condition.
(5) According to sub-section (4), if it is not possible to return the item as it is, if the value of such item is disclosed, such price, if the price is not disclosed, compensation shall be paid on the basis of the value of such item that can be maintained at the time of damage or punishment.
(6) Compensation can be paid in cash or in kind or both.
(7) If the person suffering from the crime has died before the compensation is paid as per sub-section (1), then the compensation as per sub-section (1) shall be paid to his next of kin.
